Committee Recommendation: The Administrative Committee reviewed this item on January 18, 2007 and again March 13, 2007 when direction was given to staff on development of the proposed rule. The Committee reviewed Draft Resolution 2007-03 at its April 9, 2007 meeting and recommended approval.

SUMMARY: At the December 11, 2006 meeting, the Board elected officers for 2007. During the discussion, Directors Markey and Potter commented that the Board should discuss establishment of a rule that mandates annual rotation of directors into the position of Chair. Currently, MPWMD Board Meeting Rule 2 states that rotation of the chair shall be encouraged (Exhibit 15-A). The Board’s consensus was to refer this item to the Administrative Committee for further discussion and recommendation. Draft Resolution 2007-03 (Exhibit 15-B) that contains proposed Rule 2.5, Rotation of the Vice Chair into the Position of Chair, was developed based on direction given at the March 13, 2007 Administrative Committee meeting. Staff also proposes that Rule 2, Election of Board Officers, be amended to clarify when terms begin for newly elected officers. Note that on Exhibit 15-B, Division 1 is shown at the bottom of the rotation schedule because the Division 1 director currently holds the position of Vice Chair.

RECOMMENDATION: Review Draft Resolution 2007-03 (Exhibit 15-B) and decide if the MPWMD Board Meeting Rules should be amended as proposed to establish annual rotation of directors into the positions Vice Chair and Chair.

BACKGROUND: At the request of the Administrative Committee, staff contacted the Monterey Peninsula Regional Park District (MPRPD) and the Monterey County Board of Supervisors (MCBS) for copies of their policies regarding rotation of the chair. Staff was advised by the MPRPD and MCBS that neither of the agencies have an adopted policy regarding rotation of the Chair. Both agencies follow unwritten practices for Chair rotation that are described in Exhibit 15-C.

In 1994, the District’s at-large election process converted to election from five (5) voter divisions. Subsequently, the Board established a written policy for rotation of directors into the position of Vice-Chair, with automatic rotation into the position of Chair the following year. Language from the 1994 MPWMD Board Meeting Rules is shown on Exhibit 15-D. In 1997, the Board deleted the rule for rotation of directors into the position of Vice-Chair. However, the requirement that the Vice-Chair move into the position of Chair was retained. Language from the 1997 MPWMD Board Meeting Rules is also shown on Exhibit 15-D. The rule requiring rotation of the Vice-Chair into the position of Chair was removed by the Board in 1999.

At the March 13, 2007 meeting, the Administrative Committee concluded that the Board should revive its written policies of the mid 1990’s, i.e. the Director serving as Vice-Chair automatically rotates into the Chair position, and that the Vice-Chair is selected in voter-division order. In addition, the Administrative Committee felt that the Directors representing the Monterey County Board of Supervisors and Mayors conference, respectively, should be included in the Chair and Vice-Chair rotation following voter divisions. Finally, the Administrative Committee’s proposed policy shows the 2007 Vice-Chair rotation beginning with Division 2, because Director Edwards currently serves as Vice-Chair.
