SUMMARY: At its May 18, 2020 meeting, the Board authorized water from the District Reserve Allocation in an amount of approximately five acre-feet for 66 affordable housing units at 2000 and 2600 Garden Road in Monterey. A condition of approval was that the City of Monterey enter into an indemnification agreement with the District. The City was provided a copy of the indemnification agreement for consideration.
On January 15, 2021, the District received a letter from the City of Monterey declining the indemnification agreement citing concern that the State Water Resources Control Board (SWRCB) might initiate legal action (Exhibit 2-A).
