SUMMARY: Ordinance
No. 163 (Exhibit 2-A) replaces
Urgency Ordinance No. 159 adopted in April 2014. Urgency ordinances are
effective for one year only. The proposed ordinance amends Rule 141 (Water
Conservation Rebates) to clarify eligibility changes as a result of
Non-Residential retrofit requirements enacted in 2013. Rebate amounts have been
amended to reflect changes recommended by District staff in coordination with
California American Water as part of the conservation program partnership. The
ordinance continues the financial incentives for removal of large irrigated
public lawns and retrofits to non-profit buildings that otherwise might not
replace toilets due to budget constraints, and revises several outdated areas
of the Expanded Water Conservation and Standby Rationing Plan, including
triggers for Stages 4-7 and the two day per week watering schedule.
This ordinance is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15301, Existing Facilities, for modifications to Rule 141, as these amendments relate to replacement of existing facilities with less water intensive uses. Modifications to Regulation XV are exempt from the California Environmental Quality Act (CEQA) under Water Code §10652 and CEQA Guidelines §15282 (v).
RECOMMENDATION: The Committee should review the ordinance and make a recommendation to the Board. First reading is scheduled for the February Board meeting.
