SUMMARY:  Approval of this matter by the Board of Directors shall adjust the General Manager’s compensation in accord with the terms and conditions of the District’s existing Employment Agreement with David A. Berger.  The effect shall be the payment of a one-time compensation adjustment, in the amount of six thousand ($6,000) dollars.

 

RECOMMENDATION:  The Board should consider approval of the payment of a one-time compensation adjustment, in the amount of six thousand ($6,000) dollars, in accord with the Revised Amendment Number Two to the General Manager’s Employment Agreement. 

 

IMPACT ON STAFF RESOURCES:  This item is not currently included in the FY 2007-08 budget.  If approved, this amount will be added at the time of the mid-year budget adjustment.

 

BACKGROUND:  The District employs its current General Manager, David A. Berger, pursuant to an Agreement for Employment (Agreement).  The original Agreement was entered into on June 21, 2004.  That Agreement was later amended by Amendment Number One, effective June 30, 2006, and by Revised Amendment Number Two, effective July 1, 2006. 

 

Revised Amendment Number Two incorporates by reference the original Agreement for Employment and Amendment Number One.  Based upon the determination that the General Manager met or exceeded established objectives and expectations during the 12-month performance evaluation ending June 30, 2007, the Board shall then determine whether he shall receive an increased salary or one-time compensation adjustment, or combination of both, in an amount to be then determined by the Board of Directors.  The Board has reviewed and determined that Mr. Berger has met its expectations for this period.  This action shall implement a one-time compensation adjustment for the General Manager, in the amount of six thousand ($6,000) dollars, effective July 1, 2007.
