Court Confirms Stay of SWRCB Order WR 2009-0060

 

On Monday, November 23, 2009, the Monterey County Superior Court Clerk confirmed that on November 17, 2009, the Court issued an order that maintains the earlier Stay of SWRCB Order WR 2009-0060.  The November 17, 2009 order was made in response to a request by the Attorney General’s Office on behalf of the State Water Resources Control Board to dissolve the November 3, 2009 Stay of Order WR 2009-0060.  Attorneys for the Monterey Peninsula Water Management District asked that the Stay remain in effect.

 

Pursuant to the November 17, 2009 court order, the Stay of the SWRCB Cease and Desist Order (CDO) remains unchanged.  A hearing in this case is set at the Monterey Courthouse on January 27, 2010 at 9:00 a.m. in Department 14.   This hearing will review the status of the Stay, and may address other preliminary issues such as case consolidation, intervention of parties, preparation of the administrative record and setting of trial dates.

Laredo, General Counsel for Monterey Peninsula Water Management District said “We are pleased the Court renewed our request that the State Board Cease & Desist Order be Stayed.  Without a Stay, the CDO automatically triggers Stage 5 water rationing.  It makes no sense to impose water rationing on every resident, visitor and business on the Monterey Peninsula at this time, particularly when water in the Carmel River runs into the Pacific Ocean.”
