SUMMARY:  Attached as Exhibit 2-A is the first draft of a conceptual Ordinance No. 124.  This conceptual ordinance pulls together the clarifications to the District’s permit and credit rules that have been discussed by the Water Demand Committee since August 2005.  Legal Counsel has requested review of the definitions in the context of the ordinance to ensure there are not conflicting terms.  Legal Counsel has not conducted a thorough review of the entire conceptual ordinance, although Counsel was involved in the review of each rule.  This comprehensive review will take place prior to further action.

 

Following Board referral at the January 2006 meeting, the Technical Advisory Committee (TAC) will review the draft ordinance at its February meeting, as recommended by the Water Demand Committee.  The Board is scheduled to consider the conceptual ordinance at its February 23 meeting.  CEQA review will be conducted prior to the Board’s consideration of first reading.

 

RECOMMENDATION:  The Water Demand Committee should discuss the proposed ordinance and provide feedback to staff. 

 

BACKGROUND:  The proposed ordinance is the result of staff having identified a number of permitting practices and policies that require clarification before the completion of the Policies and Procedures Manual.  Before the manual can be completed, staff is requesting a number of policies, procedures, and practices be incorporated into the rules and regulations to allow consistency in application.  Staff also plans to get input from the TAC on draft text changes.
