General Counsel Review:  Review underway; staff note/CEQA issues were addressed; ordinance review to be completed prior to first reading

Committee Recommendation: Previous action by the Committee in October 2013 and the District Board on December 9, 2013 directed that changes be made to streamline the WDS permit process

CEQA Compliance: Ordinance 160 is not a project; each individual WDS application is reviewed pursuant to CEQA

 

SUMMARY: Staff is proposing a new Ordinance No. 160 to amend the MPWMD Rules & Regulations that govern Water Distribution Systems (WDS), including Mobile WDS, based on the April 2013 Strategic Plan and Board policy direction provided on December 9, 2013.  Attached is a comprehensive package comprised of:

 

·         Draft March 17, 2014 Board meeting agenda Item 13 staff note (with 4 exhibits)

·         Draft Ordinance No. 160 (proposed Exhibit 13-A);

·         Permit Review Matrix table (proposed Exhibit 13-B);

·         Implementation Guidelines (proposed Exhibit 13-C)

·         Counsel memo on Cal-AM service for failed wells (proposed Exhibit 13-D).

 

Due to the extensive changes to Rules 20-A, 20-C, 21-A and 22-A, the proposed Ordinance No. 160 replaces the old text of these sections in their entirety and replaces them with the new text shown in the ordinance.  Marked up redline copies of these changes will be provided to the committee at its March 4 meeting if Committee members wish to review the details of changes on a paragraph-by-paragraph basis. 

 

RECOMMENDATION:  The Rules and Regulation Review Committee should review the proposed amendments, identify changes (if needed) and recommend approval to the Board.
