SUMMARY:  As a party in the California Public Utilities Commission (CPUC) proceeding for California American Water’s (Cal-Am) application for the Coastal Water Project (CWP), the District is participating in regard to the scope, governance, costs, and financing of the Regional Water Supply Project.  Through June 2010, the Board authorized consultant services by David J. Stoldt with a cost cap of $35,000.  Mr. Stoldt is an expert in public and private project financing.  The proposed amendment will add $4,000 to the contract cost cap for Mr. Stoldt’s work in Fiscal Year 2010-11 for services following the Coastal Water Project hearings in June 2010, including preparation of a memorandum examining the “debt equivalence” issue and anticipated revisions to accounting standards that arose in the proceeding.  Staff expects these issues to come up in future Cal-Am applications to the CPUC. 

 

RECOMMENDATION:  Staff recommends that the Board authorize the General Manager to amend the existing professional services agreement with David J. Stoldt to perform the services stated in Exhibit 3-A, including the addition of $4,000 to the contract cost cap.

 

IMPACTS TO STAFF AND RESOURCES:  The need FOR additional services by Mr. Stoldt was not anticipated when the Fiscal Year 2010-11 budget was adopted in June 2010.  Amending Mr. Stoldt’s contract as proposed will require $4,000 from the Capital Projects contingency fund.  District Counsel David Laredo is coordinating staff’s efforts in this proceeding, and District Engineer Andrew Bell is administering Mr. Stoldt’s contract.
