SUMMARY:  The Board must either appoint a representative to Voter Division 2, or call an election in Voter Division 2.  The action will be based on the decision made under agenda item 12, when the Board determined the preferred method for selection of a Division 2 representative. 

Outlined below are the procedures required to take action on either appointment or calling for an election.

 

            Appointment – Attached as Exhibit 13-A are letters of interest received from persons that would like to represent Division 2, and letters of support.  Any letters received after publication of this staff note will be distributed at the Board meeting.  The appointment should be made by motion.

 

            Call an Election in Voter Division 2 – If the Board specified calling an election, a resolution calling an election in Voter Division 2 must be adopted by the Board of Directors and submitted to Monterey County Elections.  Attached as Exhibit 13-B is a resolution calling for a consolidated election in Division 2 on November 3, 2015.  If the Board determines to call for a special election, the resolution can be amended.

 

RECOMMENDATION:  The Board should allow candidates to make presentations under this item.  If the Board determined to appoint, then the appointment should be made by motion.  If the Board determined under agenda item 12 to call an election in Voter Division 2, the Chair should: (a) receive a motion to adopt Exhibit 13-B and call for a vote; (b) the motion should include authorization for the General Manager to make non-substantive changes to the resolution, should they be required upon review by Monterey County Elections; and (c) authorization to fund the election in the amount determined by the County Elections office.

 

BACKGROUND:  Please refer to agenda item 12, for background information on election procedures specified by the Water Management District’s enabling legislation and California Elections Code.

 

IMPACTS ON STAFF/RESOURCES:

No costs are associated with the procedure for appointment of a Division 2 representative. Please refer to agenda item 12 for details on the cost to conduct an election in Voter Division 2.
