CONSIDER APPROVAL OF RESOLUTIONS 2013-23, 2013-24, 2013-25, 2013-26, AND 2013-27 REGARDING EMPLOYEE CONTRIBUTIONS TO THE CALIFORNIA PUBLIC EMPLOYEES RETIREMENT SYSTEM

SUMMARY:  A previous item on the Consent Calendar requested Board approval of negotiated Memorandum of Understanding (MOU) with the Confidential Staff Bargaining Unit.  This MOU includes an agreement for employees to begin paying a portion of their salary towards both the Member and the Employer portions of the California Public Retirement System (CalPERS) contribution. 

 

Currently, the District pays the entire 7% Member Contribution to CalPERS and reports the value of the Member Contribution as salary.  CalPERS  requires the District to adopt a resolution for each change to the method in which we pay and report the value of the Employer Paid Member Contribution. The changes, effective in each of the three years covered by the MOU’s, are addressed by Resolution 2013-23, attached as Exhibit 6-A, Resolution 2013-24, attached as Exhibit 6-B and  Resolution 2013-25, attached as Exhibit 6-C.

 

Currently, the District pays the entire 13.532% Employer Contribution to CalPERS. Resolution 2013-26, attached as Exhibit 6-D, would allow employee payments towards the Employer Contribution to be made on a pre-tax basis, in accordance with Section 414 (h) (2) of the Internal Revenue Code. 

 

Additionally, the California Public Retirement System requires a foundation resolution regarding Member payments made by the District, or the Employer Pick-up. Resolution 2013-26, attached as Exhibit 6-E, would apply to the employees in all District Bargaining Units, who will now be commencing to have deductions taken from their paychecks to be applied to their retirement premiums.

 

RECOMMENDATION: Approve the Resolutions regarding Employee contributions to the California Public Employees Retirement System, if approval is granted to the negotiated MOU with the Confidential Staff Bargaining Unit.
