SUMMARY:   At a public hearing on August 20, 2012 to address an appeal by David and Judy Beech regarding the Flores Water Distribution System (WDS), Application #20110401FLO on APN 103-071-002 at 564 Monhollan Road, Carmel, the Board determined that the July 12, 2012 approval of the application by the District Engineer should be upheld, and that MPWMD WDS Permit S12-03-L2 should be issued, subject to the original 26 Conditions of Approval as written by staff (“Option 1”).  This action meant that the appeal was denied.  The materials associated with this action may be found on the District website at:

The Board also directed staff to develop Findings of Approval for consideration as a Consent Item on the September 17, 2012 agenda.  The Findings are attached as Exhibit 4-A, and will be adopted if the Board approves the Consent Calendar.

 

Pursuant to Rule 70, the applicant and appellant have been advised in writing of the Board’s decision.  As directed by the Board, Mr. Beech’s $750 appeal fee was refunded.

 

RECOMMENDATION:  The Board should adopt the Findings attached as Exhibit 4-A, which focus on the rationale for the Board’s decision.
