SUMMARY:  The purpose of this item is for the District Board to appoint a representative and alternate from the MPWMD to serve on the Watermaster board for a two-year term, as required in the Seaside Basin adjudication court decision.   Director Lehman currently serves as the MPWMD Watermaster board representative, and Chair Markey is the alternate.  There is no District rule that specifies who on the Board should serve as representative to the Watermaster.  Traditionally, the Board Chair was appointed as the representative, and the Vice Chair served as the alternative.  Director Lehman has offered to continue as the MPWMD representative for another two-year term.   Director Doyle, who will be appointed as Board Chair should the rotation schedule continue, has no objection to the appointment of Director Lehman as Watermaster representative.  Director Brower has agreed to serve as alternate to the Watermaster.  There is no rule that would prohibit the Board from changing these appointments in 2011.

 

RECOMMENDATION:  Staff recommends that the Board appoint Director Lehman as representative to the Watermaster, and Director Brower as the alternate.

 

BACKGROUND:  The District is required to appoint a representative to serve a two-year term on the Watermaster board, in accordance with Judge Roger D. Randall’s March 2006 decision in California American Water v. City of Seaside, et al. (Monterey Superior Court, Case No. M66343).  The Watermaster board subsequently approved and submitted to Judge Randall rules that also provide for each entity’s appointment of an alternate to the Watermaster board.
