The meeting was called to order at 9:10 AM in the conference room of the Monterey Peninsula Water Management District office.

Action Items
1. Receive Minutes of April 13, 2009 Committee Meetings
On a motion by Director Brower and second by Director Markey the minutes were received unanimously on a vote of 2 - 0.
2. Develop
Recommendation to the Board Regarding First Reading of Ordinance No. 140,
Amending the Rebate Program Amounts, Deleting 1.6 Gallon Per Flush Toilets from
the Rebate Program, and Adding Rebates for Lawn Removal, Synthetic Turf
Installation, and Other Commercial/Industrial/Institutional Retrofits
The committee discussed the ordinance and agreed to the following. (1) Amend the ordinance to state that when the $15,000 fund allocated for turf replacement has been exhausted, staff will present a report to the Board on how the funds were spent and if the program should be renewed. (2) The definition of turf shall be “an area of land planted with live, healthy grass which is maintained, irrigated and groomed to a low and even height.” (3) District staff shall have the discretion to determine if an area of grass meets the definition of turf. (4) The rebate for turf replacement will apply to installation of low-water use plants or permeable surfaces. (5) An applicant could receive a rebate for both turf removal, and replacement with low-water use plants or a permeable surface. (6) The maximum area that will qualify for a turf removal rebate will be 2,000 square feet.
3. Develop
Recommendation to the Board Regarding First
The committee recommended that the ordinance be bifurcated, by removing sections that refer to abandonment of water credits for mandatory installation of some high-efficiency water fixtures. On October 19, 2009, the Board will consider first reading of an ordinance that amends Regulation XIV, but would not impact Rule 25.5, Table 4: Residential Ultra-Low Consumption Appliance Credits. On December 14, 2009, the Board could consider first reading of an ordinance that would address Rule 25.5, Table 4 and the removal of water credits for mandatory installation of some high-efficiency water fixtures. The committee reasoned that there was no immediate need to deny the reinvestment of water credits. In the future, if the draft Cease and Desist Order against California American Water is adopted, the PUC may forbid reuse of water credits and the District’s rules would need to be amended.
