SCOPE OF SERVICES

 

The Consultant shall provide oversight, analysis, and support for financial issues and testimony under CPUC A.04-09-019 Phase 2 as they relate to MPWMD and its ratepayers.  Such activities shall include:

Task 1:  Review of written testimony submitted by Cal-American Water Co. May 22, 2009

Task 2:  Review of written testimony submitted by Marina Coast Water District June 19, 2009

Task 3:  Review of other documents relating to both projects, including but not limited to EIR

Task 4:  Attendance and participation in the ALJ’s facilitated workshops on cost issues July 7-9, 2009

Task 5:  Identification of additional data needs, comparison of methodology in cost analyses, identification of additional cash flow modeling to be done, if any, to ensure appropriate comparison of costs for alternate projects.  Advise MPWMD on appropriate requests for additional information/data

Task 6:  Preliminary advice on structure and cost sharing under interagency agreement for pubic project; Identify methods of cost recovery; identify impact on MPWMD ratepayers for both projects.

Task 7:  Assist MPWMD in preparation of written testimony due August 14, 2009

Task 8:  Assist in preparation of oral remarks by MPWMD at evidentiary hearings and/or final oral argument request, if necessary

Task 9:  Provide expert witness direct testimony in the CPUC A.04-09-019 hearing, as requested by MPWMD

“Optional Tasks” (on “as needed” basis):  It is hoped that sufficient data will be presented by the participants in the proceedings to inform the desired outcomes by the Consultant.  However, data requests and methodologies performed by other parties may not provide complete data for comparison of alternatives, or the impacts on MPWMD ratepayers.  Any detailed cash flow modeling to be undertaken and performed by the Consultant will be done after discussion with and approval by MPWMD.  Additionally, any in depth evaluation of cost allocation and/or interagency agreements for MPWMD participation in a public project will be done after discussion with and approval by MPWMD.   Tasks later identified (“Additional Tasks”) may be undertaken only if requested and authorized by MPWMD with an amendment to this Agreement.

Deliverables:  After completion of Task 3 and before Task 4, a written overview of key findings and issues shall be completed.  Following the workshops (Task 4) as part of Task 5, identification of additional findings, issues, and data needs will be prepared.  Prepared testimony will be delivered as needed (Task 9.)  If “Optional Tasks” are elected by MPWMD, then written summaries, spreadsheets, and/or reports will be delivered as appropriate.
