The meeting was called to order at 9:35 AM.

Action Items

 

1.                  Receive Minutes of the August 5, 2008 Technical Advisory Committee Meeting

On a motion by Bennett and second by O’Halloran, the minutes were received unanimously on a vote of 6 – 0. 

 

2.         Develop Recommendation to the Board of Directors on Draft MPWMD Policy Regarding Installation of Dual Plumbing Systems

            Hardgrave offered a motion that was seconded by Bennett, requesting that the District pursue this issue as follows.   (1) Explore options for off-site or on-site water conservation measures that could be implemented if the subpotable water source fails, and there is a temporary or permanent increase in potable water use.  (2) Solicit input from the Monterey County Environmental Health Department regarding coordination with well permitting regulations.  (3) Carefully evaluate the staff time and cost to the District to monitor and enforce a dual plumbing system ordinance.  (4) Describe to the MPWMD Board of Directors all the consequences of allowing dual plumbing systems in a building.  The motion was approved unanimously on a vote of 6 – 0.

           

3.         Discuss Coordination with Monterey County and Cities in the District Regarding Establishment of Regulations Allowing Greywater, Rainwater and Recycled Water Systems to Encourage Household, Business and City Water Catchment, Storage and Reuse

            On a motion by Matarazzo and second by Dadiw, the committee recommended that the Board adopt an ordinance that would allow the use of alternative water sources, subject to each jurisdiction’s regulations.  The ordinance should read, “The following greywater systems shall be allowed within the District (list those systems) subject to local land use regulations, State and regional health regulations, and State building code.”  The motion was adopted unanimously on a vote of 6 – 0.

 

Oral Reports

4.         Update on Status of State Water Resources Control Board Deliberations re Draft Cease and Desist Order 

            Laredo reported that the State Water Resources Control Board conducted hearings on the Draft Cease and Desist Order (Draft CDO) in June, July and August of 2008.  Hearing officers could submit a proposed decision for consideration before the SWRCB by December 2008. However, it is more realistic to assume that hearing would take place in January or February 2009.  Once the SWRCB issues the order, any of the 18 parties involved in the proceedings could ask for reconsideration in Superior Court.   It is likely a hearing for reconsideration would take place in March or April 2009.  If so, a final decision might be issued in late spring 2009 or June 2009.  Mr. Laredo gave his report prior to discussion of item 3.  He departed from the meeting at 10:50 AM.
