Rules and Regulations Review Committee

of the

Monterey Peninsula Water Management District

January 7, 2008

 

 

Call To Order

The meeting was called to order at 8:35 AM in the District conference room.

No members of the public were in attendance.

 

Action Items

1.         Approve Revisions to Deed Restriction Templates

            On a motion by Director Edwards and second by Director Pendergrass, the committee unanimously approved the deed restriction templates on a vote of 3 – 0.

 

2.         Consider Revised Concept Ordinance that Would Add To and Amend the Process for the Administrative Enforcement of District Rules and Regulations

            The committee reviewed the concept ordinance and agreed to meet again to discuss an amended draft that would include the following changes. (1) Add language that authorizes the General Manager to issue a cease and desist order.  (2) Include the option to refer issues to an Administrative Law Judge. (3) Ensure that the proposed administrative enforcement process is consistent with existing District regulations.  (4) The fine schedule should be updated to show the minimum fine as $150.  Staff was directed to review fine schedules from other jurisdictions to determine if the $150 minimum is comparable.
