RESOLUTION NO. 2008‑05

 

A RESOLUTION OF THE BOARD OF DIRECTORS OF

THE MONTEREY PENINSULA WATER MANAGEMENT DISTRICT

EXPRESSING OPPOSITION TO CALIFORNIA pROPOSITION 98

 

            WHEREAS, California’s water system is facing significant challenges, ranging from court-ordered cuts in water deliveries to looming impacts of climate change; and

           

 WHEREAS, in order to address those challenges California must invest in water projects that protect and restore the environment and ensure reliable water supplies for the state’s economy and its growing population; and

 

WHEREAS,  proposition 98, an initiative on the June 2008 ballot, could make it more difficult and expensive for public water agencies to use eminent domain to acquire land for necessary water projects and facilities; and

 

WHEREAS, this measure could derail the kind of water infrastructure projects California needs to ensure reliable water for its residents, businesses, environment and agriculture; and

 

WHEREAS, examples of threatened projects include acquisition of land for reservoirs, ground water and surface storage projects, Delta conveyance improvements, rights-of-way for pipelines and canals to deliver water to new homes and businesses; and

 

WHEREAS, the initiative conflicts with several policy principles adopted by ACWA’s Board of Directors, and those principles call for ACWA to oppose any proposal that limits a water agency’s right to make use of property acquired by eminent domain or that adds to the costs or burdens imposed on water agencies in the condemnation process; and

 

WHEREAS, the Association of  California Water Agencies, a statewide association with over 450 members who are responsible for approximately 90% of the water delivered in California, voted to oppose Proposition 98 in September 2007 even before its qualification; and

 

WHEREAS, the Monterey Peninsula Water Management District is responsible for managing the water supply for 106,596 people in the cities of Carmel, Del Rey Oaks, Monterey, Pacific Grove, Seaside, the Monterey Peninsula Airport District and some unincorporated areas of Monterey County.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Monterey Peninsula Water Management District that we OPPOSE Proposition 98.
