SUMMARY: The purpose of this item is for the Board of Directors to review and consider a request made by the Policy Advisory Committee (PAC) in its January 31, 2008 joint meeting with the Technical Advisory Committee (TAC). Specifically, the PAC requested that the Environmental Impact Report (EIR), which would be needed in order for the District to move forward with the Subpotable Water Credit/Transfer draft concept ordinance, be expanded to include potable water credit transfer. The Chair/Vice Chair Committee discussed the PAC request at its March 4, 2008 meeting, and referred this item to the Board for review and consideration, before further effort is expended on this matter by District advisory committees, staff and legal counsel.

RECOMMENDATION: It is recommended that the Board discuss and provide policy direction to District staff and legal counsel regarding the PAC’s request to increase the scope of the Subpotable Water Credit/Transfer concept ordinance EIR to include potable water credit transfer.

BACKGROUND: The staff report for the January 31, 2008 joint meeting of the PAC and TAC provides background information related to the Subpotable Water Credit/Transfer draft concept ordinance and EIR that would need to be prepared for the Board to consider its future adoption (Exhibit 17-A). District staff prepared a memo summarizing the January 31, 2008 joint PAC/TAC meeting outcome.
