SUMMARY: There are two items to refer to the Technical Advisory Committee in the month of January 2006:

1. City of Monterey Request for Rule 28 Transfer Amendment. Attached as Exhibit 3-A is a request from the City of Monterey to amend the water credit transfer regulations to allow water credit to be granted for those areas where use of potable water for irrigation is discontinued and replaced with nonpotable water. This item was initially discussed by the Technical Advisory Committee (TAC) on October 4, 2005 and was continued to a date uncertain for the City of Monterey to coordinate with the other jurisdictions and refine the request.

2. Draft Ordinance 123, Clarifying Rules Related to Water Permits and Credits. The Water Demand Committee has been reviewing proposed rule clarifications since August 2005 as part of the Strategic Plan to complete a Policies and Procedures Manual for the Water Demand Division. The proposed ordinance is the result of staff having identified a number of permitting practices and policies that need to be incorporated into the rules and regulations to allow consistency in application. The Water Demand Committee has requested input from the TAC on the draft ordinance.

RECOMMENDATION: District staff recommends these two items be referred to the Technical Advisory Committee for discussion and possible action in the form of recommendations to the Board. Approval of this item with the Consent Calendar will refer the items to the TAC.
