RESOLUTION No. 2004 --

 

Resolution of the Board of Directors

of the Monterey Peninsula Water Management District

Declaring Its Intent to Prepare a Groundwater Management Plan for the Seaside Groundwater Basin and Adopting a Statement of Public Participation

 

 

WHEREAS, the Monterey Peninsula Water Management District is charged under the Monterey Peninsula Water Management District Law with the integrated management of the ground and surface water resources in the Monterey Peninsula area; and

 

WHEREAS, the Monterey Peninsula Water Management District is committed to the protection, preservation, and enhancement of the groundwater resources in the Seaside Groundwater Basin for current and future beneficial uses; and

 

WHEREAS, the Monterey Peninsula Water Management District has conducted or commissioned almost all of the significant technical and hydrogeological studies of the groundwater resources in the Seaside Groundwater Basin since the District’s inception in 1978; and

 

WHEREAS, the Monterey Peninsula Water Management District has implemented and maintained monitoring programs to track changes in groundwater extractions, groundwater levels and groundwater quality in the Seaside Groundwater Basin since 1980; and

 

WHEREAS, the Monterey Peninsula Water Management District believes that development, adoption and implementation of a plan for the management of the groundwater resources in the Seaside Groundwater Basin is necessary to prevent undesirable impacts such as depleted groundwater storage or seawater intrusion from occurring; and

 

WHEREAS, the California legislature has recognized the importance of groundwater and the need for local control and monitoring in making sound groundwater management decisions; and

 

WHEREAS, the California legislature enacted Senate Bill 1938 in 2002 to provide incentives to local agencies for proactively planning and implementing effective groundwater management programs and specified that groundwater management plans must be prepared and include certain components to be eligible for the award of public funds administered by the Department of Water Resources for the construction of groundwater projects.

 

NOW THEREFORE, BE IT RESOLVED, and ordered by the Board of Directors of the Monterey Peninsula Water Management District that:

 

1.      The Monterey Peninsula Water Management District intends to develop, adopt, and implement a groundwater management plan for the Seaside Groundwater Basin.  Among other components, the District’s management plan shall include the following components:

 

a.       Basin Management Objectives;

 

b.      Components relating to the monitoring and management of groundwater levels, groundwater quality, groundwater banking, inelastic land surface subsidence, and changes in surface flow and surface water quality that directly affect groundwater levels or quality or are caused by groundwater pumping;

 

c.       Monitoring protocols to track changes in conditions related to the components in section (b) and to generate information for the purpose of meeting Basin Management Objectives and establishing effective management of groundwater;

 

d.      A plan to involve other local agencies, jurisdictions, and purveyors in the Seaside Groundwater Basin in the development of the groundwater management plan;

 

e.       A map depicting the area overlying the Seaside Groundwater Basin, the jurisdictional area of the Monterey Peninsula Water Management District, and the boundaries of other local agencies and water purveyors in the Seaside Groundwater Basin; and

 

f.        Rules related to implementation of the groundwater management plan. 

 

 

2.      The Monterey Peninsula Water Management District further intends to provide and allow broad opportunity for public involvement in the development of the groundwater management plan for the Seaside Groundwater Basin.  The District’s plan for public involvement shall include the following:

 

a.       The formation of an Advisory Committee of interested parties to guide development of the groundwater management plan; and

 

b.      Public review and comment period and public hearings

 

 

On motion of Director ________ and seconded by Director ________, the foregoing resolution is duly adopted this 19th day of February 2004 by the following votes:
