Revisions and
Corrections to
Draft of Second
Reading of Ordinance No. 109
Director Henson offered a motion to approve the second reading of Ordinance No. 109 as presented by District Counsel that evening, including the addition of section 23.5(4)(d) on page 51 of the Board Packet which states “Excepting for fixtures in a residential remodel, all new water using fixtures that use a portion of the water entitlement shall have the water entitlement separately metered.” Director Lindstrom seconded the motion. The motion was approved unanimously on a vote of 7 – 0.
Revisions and Corrections Presented by Special Counsel
1. Page 46 of the packet, paragraph C, line 9, the reference to I, J, K, and L should also include a reference to E.
2. Page 48 of the packet, paragraph G, line 12, the reference to I, J, K and L should also include a reference to E.
3. Page 50 of the packet, paragraph L , line 6, delete the word “decribed” and replace it with the word “described.” Also, delete the word “this” and replace with the word “the.” In addition, add the following phrase at the end of the sentence, “of supplemental financial commitment in subsection 4G.”
4. Page 51 of the packet, footnote 1 – Special Counsel Nelson asked the Board to review the footnote and determine if the language shown in paragraph (5) should remain in the ordinance. Once the determination is made, the footnote can be deleted.
5. Page 51 of the packet, -- Special Counsel Nelson suggested that a new sub-paragraph (d) be added, “All new water using fixtures that will use any portion of the Water Entitlement shall be separately metered, for use other than residential remodeling.”
6. Page 54 of the packet, last line on the page, after the words “similarly situated users” insert the phrase “(such as parties to water credit transfers, pursuant to Rule 28.5, except residential remodels).”
7. Page 57 of the packet, line 2, after the words “similarly situated users” insert the phrase “(such as parties to water credit transfers, pursuant to rule 28.5 except residential remodels).”
8. Page 60 of the packet, paragraph 4, after the words “payment of expenses incurred” insert the words “by MPWMD, CAWD, PBCSD.”
9. Page 68 of the packet, line 9, delete the word “Managemnet” and replace with the word “Management.”
10. Page 69 of the packet, Exhibit A, attach the legal descriptions of the four lots that are outside of the Del Monte Forest that are included in the legal description of the benefited properties in the August 17, 1998 Technical Amendment. District staff should verify the legal descriptions on file and then attach them to Exhibit A.
