PROCESS FOR MPWMD PERMITS FOR WATER DISTRIBUTION SYSTEM CREATION, AMENDMENT OR ANNEXATIONS

This is a general description of the process; steps and timing could vary with individual permit applications. There are three phases: information, CEQA and Board action. Staff tries to run these concurrently, whenever possible. Applicants should expect three to four months to obtain a permit; some situations may be faster or slower based on the complexity of the permit and meeting dates available for Board action.

INFORMATION PHASE
 
STEP IN PROCESS COMMENTS/TIMING
1. Pre-application consulation Meet with staff to assess situation, which forms apply, required information, timing, fees 
2. Submit formal application with fee Starts 30-day response clock; begins tally of staff hours for processing fee (if applicable)
3. MPWMD sends completeness letter; includes posting/public notice requirements, what info is needed for CEQA and by when; what other info needed for staff analysis and by when. If complete, skip to Step 6 Within 30 days of application receipt (with fee) MPWMD must respond; advise if application is complete, and if not, what information must be developed in order to comply with CEQA, MPWMD Rules and Regs, anticipated Board and public questions
4. Applicant submits requested information MPWMD has 15 days to inform applicant if info is complete; if not, why not, what needed
5. MPWMD confirms information is complete; describes what is needed and why repeat steps 4 and 5 as needed

CEQA PHASE -- complies with California Environmental Quality Act
 
STEP IN PROCESS COMMENTS/TIMING
6. All info needed for CEQA received 62 days prior to Board action
7. Staff prepares Initial Study (assume 1 wk) 55-62 days prior to Board action
8. Initial Study filed with Clearinghouse/Clerk 55 days prior to Board action. Includes 30-day comment period. I.S. may be included on Consent Calendar during this time 
9. Receive public comment 21 days prior to Board action; issues raised by public described in staff note 

BOARD ACTION PHASE
 
STEP IN PROCESS COMMENTS/TIMING
10. All other info needed for staff note received from applicant 21 days prior to Board action
11. MPWMD sends posting notices and certification form to applicant; may request pre-stamped envelopes for mailing list 14-21 days prior to Board action
12. MPWMD receives stamped, pre-addressed envelopes for owners of parcels affected by project no later than 14 days prior to Board action
13. MPWMD develops notice in Herald along with agenda; printed 10 days prior
14. Staff analysis and Board packet materials, including De Minimis form if needed; review by General Manager  due 14 days prior to Board action
15. Posting/notices completed 10 days prior to Board action
16. Presentation materials developed 1-2 days prior to Board action
17. Receive certification of posting on or before day of Board action
18. Public hearing/Board action Scheduled Board meeting
19. File NOD/De Minimis with County, SCH if state action; pay $25 fee to County 1-3 days after Board action
20. Letter to applicant with final conditions, confirmation form, bill for services, copy of NOD and other info (see note below) 1-5 days after board action
21. Receive confirmation form and payment from applicant applicant response (up to 30 days)
22. Receive posted NOD from County; note if litigation filed within 30-day period County sends posted NOD after 30 days
23. Final letter confirming formal approval of application -- end of action 1-7 days following receipt of confirmation form, payment, and NOD from County

PROCESSING FEES: The permit does not go into effect until all processing fees have been paid to MPWMD by the applicant, according to MPWMD Rule #60. Applicant will be provided documentation of staff hours along with the bill for processing. The rates for staff hours are presently $30 per hour.
